En marzo de 2020, se promulgó la Ley de Respuesta al Coronavirus Families First (FFCRA, por sus siglas en inglés) para ayudar a las empresas a ofrecer licencias por enfermedad pagadas y beneficios por desempleo debido al COVID-19. Inicialmente, la FFCRA se dirigió a los empleadores con empleados W-2 para ayudarles a enfrentar los desafíos económicos causados por la pandemia. En diciembre de 2020, el Congreso aprobó la Ley de Ayuda, Alivio y Seguridad Económica por Coronavirus (CARES, por sus siglas en inglés), que amplió el alcance de la FFCRA. Esta expansión ahora incluye a los trabajadores por cuenta propia, freelancers, contratistas independientes y trabajadores de la economía gig. Como resultado, estos grupos son elegibles para créditos fiscales que compensan la pérdida de ingresos causada por el COVID-19. Estos créditos fiscales se conocen como el Crédito Fiscal para Trabajadores Autónomos o “SETC”.
A diferencia del Programa de Protección de Cheques de Pago (PPP), la FFCRA no es un préstamo, sino un crédito fiscal retroactivo para sus impuestos sobre la renta de 2020 o 2021. Este crédito reducirá el monto actual que debe al IRS o se le enviará directamente en forma de cheque o depósito ACH, según su estado tributario. Cualquier crédito FFCRA que se le envíe directamente puede utilizarse como lo necesite y no tendrá que ser devuelto nunca.
